Terms of Service

These terms cover your use of Tracking Construction (“the service”), run by Chris Carpio, a sole proprietor in New Jersey (“we”, “us”). By creating an account or using the service you agree to them. If you’re signing up for a company, you agree for the company, and you confirm you’re allowed to.

What the service does

Tracking Construction helps construction companies run their crews: clocking in and out at job sites, hours by job, weekly timesheets for payroll, job costs, photos and receipts. It works out hours from what people enter and where their phones say they are. It is not a payroll service, and nothing in it is legal, tax or accounting advice.

Accounts

  • The person who creates a company is its owner. The owner decides who joins, what role they have, and approves the hours.
  • Keep your password to yourself. You’re responsible for what happens under your account; tell us right away if you think someone else has used it.
  • Give us accurate details, and keep your email current: password resets and billing notices go there.
  • You must be old enough to make a binding contract to create a company. Crew members invited by a company use the service under that company’s account.

Free trial, prices and billing

  • New companies get a 30-day free trial. A card is needed to start it. Cancel before the trial ends and you’re never charged.
  • After the trial the price is the one shown at signup and on the Billing page: today, $150 a month for the company with the owner included, plus $20 a month for each additional person who can sign in and use the app (admins and crew). Bookkeepers are free. Prices are in US dollars, before any applicable taxes.
  • You’re billed monthly, in advance, by our payment processor, Stripe. Adding or removing people changes the next bill.
  • Charges appear on your card statement as KO-FI.COM - CARPIOSUPP.
  • If we change prices, we’ll email the owner at least 30 days before the new price applies.
  • If a payment fails, the company becomes read-only until billing is fixed. Clocking out always keeps working.

Cancelling and refunds

  • The owner can cancel any time from the Billing page.
  • After the trial, cancelling stops the next charge. You keep access until the end of the month you’ve paid for.
  • We don’t give refunds or credits for part-months, people removed mid-month, or unused time, except where the law requires it.
  • If you think you were charged by mistake, write to us at chris@occasioroasters.com before disputing it with your bank, and we’ll sort it out.

Your company's data

  • Your company owns what it puts in: people, jobs, time records, photos, receipts and reports. You let us store and process it only to run the service for you. Our Privacy Policy says what we collect and who helps us run it.
  • You can download timesheets as PDF and CSV at any time. You can ask us to delete your company’s data, and we will, except what we must keep by law (for example, billing records).
  • Don’t put Social Security numbers, bank account numbers or tax IDs into the service. It isn’t built to hold them; those belong with your payroll provider.

Your responsibilities as an employer

  • The service records the location of a crew member’s phone when they clock in or out. Tell your crew it does this, and get their consent wherever the law requires it.
  • Check timesheets before you approve them. You’re responsible for paying people correctly and for following wage-and-hour, overtime, break and record-keeping laws.

Acceptable use

Don’t use the service to break the law, to harass anyone, to upload anything you don’t have the right to share, or to try to get into another company’s data, overload the service or get around its limits.

Changes and availability

We keep improving the service and may change or remove features. We aim to keep it running, but we can’t promise it will always be available or free of errors. If we change these terms in a way that matters, we’ll tell owners by email or in the app before the change takes effect.

Suspension and ending

We may suspend or close an account that breaks these terms or doesn’t pay, after telling the owner when we reasonably can. You can stop using the service at any time. The sections on data, liability and governing law still apply afterwards.

Warranty and liability

  • The service is provided “as is”, without warranties of any kind, to the extent the law allows.
  • We aren’t liable for indirect or consequential losses, such as lost profits, lost data or business interruption.
  • Our total liability for any claim is limited to what your company paid us in the 12 months before the claim (or $100 if it paid nothing).

Governing law

These terms are governed by the laws of the State of New Jersey. Any dispute goes to the state or federal courts located in New Jersey.
